This is the case with the monster, Grendel, in Beowulf, by John Gardner. Grendel feels excluded from humans in general, because he cannot understand them. He feels as though he does not belong to a community, because he has been living alone with his mother for such a long time. Overall, it is the combination of many different types of exclusions that pushes Grendel to become such a cruel, hideous beast with a hardened heart and a thirst to kill.Grendel is where most of the description of this monster is located. It is said that Grendel swam across a lake of fire snakes to reach human civilization. Here, he observes human civilization from up close, and he does not understand what he sees. He feels very different from those living in that society. In addition, Hrothgar becomes king and is given power and riches. He even builds a giant meadhall called Hart. Grendel is drawn in, discovers the Shaper, and becomes more curious. However, after a visit to the dragon, also an outsider, Grendel’s mind is changed because the dragon makes all these things sound so undesirable.Talking to the dragon was the turning point for Grendel, and soon after, he becomes filled with rage and starts raiding Hart and harming the people inside. â€Å"His misery leaped / The seas, was told and sung in all / Men’s ears: how Grendel’s hatred began, / How the monster relished his savage war / On the Danes†¦Ã¢â‚¬  (lines 64-68). This proves that it was Grendel’s original longing to belong that made him this way. It is very likely that Grendel would not have become such a horrible monster if it had not been for his feelings of jealousy.It is always hard to feel different and not accepted, and that is exactly how Grendel feels. Throughout the rest of the story, Grendel takes out his anger and wrath on se emingly innocent people, but there may be more to the story than what appears on the surface. These peope could have helped and included him, instead of letting him watch from the outside looking in. Jealousy drives people to do crazy things, and in Grendel’s case, jealousy of power, money, and acceptance are what make him change into a terrifying, cold-blooded killer that needs to be stopped, eventually, by Beowulf.

Lord Bingham adopted the definition cited in the draft criminal code of 1989 wherein a person is said to act recklessly if â€Å"with respect to (i) a circumstance when he is aware of a risk that it exists or will exist; (ii) a result when he is aware of a risk that it will occur; and it is, in the circumstances known to him, unreasonable to take the risk.†8 Metcalfe and Ashworth explains that from this definition, it can be deduced that â€Å"any awareness of any degree of risk satisfies the definition, and that the judgment of the unreasonableness of  a risk (when that issue is contested) is for the tribunal of fact.†9 With this, they foresee that this same definition may be used uniformly throughout the criminal law, except for judges who would substitute the term â€Å"reckless† with â€Å"gross negligence† necessary in a manslaughter conviction.10 Finally, Metcalfe and Ashworth discusses the question of legal policy as regards the liability of children, taking into consideration the differing standards applicable to children and mentally disordered people, from that of adults who are of sound mind and hence, should have been aware of the need to take care. In the short story, â€Å"The Jilting of Granny Weatherall,† written by Katherine Anne Porter, the main character, Granny Weatherall is doing just that; looking back on her life. In the film made based on this short story Granny Weatherall also thinks about her life, but as she is doing things around the house, living her life and not while being shut up in her bed. There are other differences that take place between both the film and the short story. But in the end they both tell the story of an old woman named Granny Weatherall. The short story version of â€Å"The Jilting of Granny Weatherall† has a stream of consciousness point of view. It is basically Granny Weatherall, while lying in her death bed, going over previous events that had taken place in her life as they came to her mind and thoughts. Granny Weatherall also thinks about things that she is planning on doing the next day. â€Å"The box in the attic with all those letters tied up, well, she’d have to go through that tomorrow.† (17). That was Granny Weatherall thinking to herself about going through some personal letters she did not want Cornelia, her daughter that she lives with, to find. In the film version of The Jilting of Granny Weatherall the viewers get to see the story of Granny Weatherall in an objective point of view. The story is showed by Granny Weatherall actually being out of bed and doing things. While she is going about her day, the film shows us her thoughts through little flashbacks Granny Weatherall has. Different from the short story, Granny Weatherall actually goes up to the attic and goes through the letters and Cornelia comes up there with her. There is also some symbolism that takes place in the film that does not happen in the short story. â€Å"What does a woman do when she has put on the white veil and set out the white cake for a man and he doesn’t come?† (29). Granny Weatherall thinks about this in the short story, but actually makes a white cake in the film, symbolizing her jilting and how she still thinks of it. After reading the short story and viewing the film, I prefer the actual short story in the book over watching it. Reading it the first time was a little confusing. But after watching the film and then going back and reading the short story over again, it makes enjoy the story so much more. I now know that the story is told through Granny Weatherall’s thoughts and so when I read I can get a better understanding of who Granny Weatherall is. Also, I believe that reading the last sentence of the short story the reader gets to enjoy a better view in their mind then when what the film shows. â€Å"She stretched herself with a deep breath and blew out the light.† (61). Both the film and the short story of â€Å"The Jilting of Granny Weatherall† were great. The film is easier to follow the first time watched but the book takes the reader through Granny Weatherall’s inner thoughts. They have some differences amongst themselves but they also both share the common theme of someone thinking about their life right before death comes.

Cooperation and exchange among individuals often organize in firms rather than adhering to market institutions. This anomaly of market systems can be explained through what Oliver Williamson calls â€Å"Transaction Cost Economics.† Transaction costs are defined as the â€Å"costs of running the economic system† (Williamson 18). Similar to friction in a physical system, transaction costs may be small compared to other costs such encountered by market players, but basing entire models on a ‘frictionless’ system is unrealistic. It is these transaction costs explain the development of firms and hierarchies rather than contracting by market forces. There are three limitations to a market system: bounded rationality, opportunism and asset specificity. Bounded rationality describes the limitations of knowledge by market players. Whereas they will act rationally in a market situation, they are not always presented with all the information required to make a rational decision. Opportunism arises when certain market players are unwilling to accept the status quo and believe they have the ability to improve their position. Finally, asset specificity refers to certain players having technical and contractual inseparabilites. An example of asset specificity is an accounting firm with a long term contract with a given company. After the long term contract expires, the accounting firm would be first in line to renew their contract with the given company. There may be other accounting firms in the market that could also offer similar accounting services, but the company will likely keep its original accounting firm. Switching wo uld incur transaction costs such as transferring of files over to the new accounting firm, legal fees associate... ... asset specificity can no longer be ignored as in classic market models. A highly trained employee is a very specific asset since a firm would incur great costs in training a novice employee and bringing the novice’s productivity up to that of a highly trained employee. Thus, a firm could not easily replace the highly trained employee as the case would be in a market situation. Thus non market contracts are forged to keep the specific asset that is high human capital. Williamson and Coase use transaction cost economics to explain why labor is often organized in firms rather than relying on market institutions. The increasing effect of asset specificity on the labor market is a key validation for their analysis. Firms are more efficient than market institutions in that they save on transaction costs associated with writing, signing and enforcing contracts.

As stated in Field Manual 100-5 these include objective, offensive, mass, economy of force, maneuver, unity of command, security, surprise, and simplicity. 1 Napoleon had 115 maxims, Sun Tzu had 13 principles, but Nathan Bedford Forrest’s advice was the utmost of simplicity, â€Å"Git thar firstest with the mostest men.†2 As we look at the challenge facing our nation’s military today, our leaders would do well to look at Forrest’s campaigns and strategies as a guide.   Ã‚  Ã‚  Ã‚  Ã‚  . Forrest won respect for risking his life while trying to save his aging uncle. Subsequently, Forrest won the affection of Mary Montgomery who, in 1845, became his wife.   Ã‚  Ã‚  Ã‚  Ã‚  In 1851 Bedford moved to Memphis. He won several elections as an elderman and prospered as a businessman. When he closed out his business in late1859 war was eminent. He was involved in his own cotton business and was busy putting his family affairs in order. His net worth was 11/2 million dollars and he was netting $30 thousand a year for his cotton. While he was a slave trader during this period, Colonel Adair described his actions as â€Å"Forrest was kind, humane, and extremely considerate of his slaves. He seemed to exercise the same influence over them that in a greater degree he exercised over the soldiers who served him as devotedly as if there was between them a strong personal attachment.5 On 14 June 1861, he enlisted in Memphis as a soldier in Captain White’s Tennessee Mounted Rifles Company.6 This unit would become a subordinate unit of the Seventh Tennessee Calvary Regiment. Forrest was the unit’s commander when the war ended. Friends of Forrest’s approached Governor Harris and General Polk, which subsequently resulted in an authorization allowing Forrest to raise a battalion of mounted rangers. By October of 1861 he had eight companies of men comprising a total of 650. Most arrived with pistols and shotguns, as well as horses, which resulted in Forrest still attempting to obtain rifles for them when the unit was ordered to Dover as reinforcement for what was to be Fort Donelson. The second step in the scientific method is question. To question one must make an attempt to explain the observation that was made. The next step in the scientific method is making a hypothesis. A hypothesis is made to predict a solution and an outcome. The fourth step in the scientific method is making a prediction. When making a prediction you are indicating the outcome. Next is the conclusion.The conclusion details the findings of the testing. This then leads to the final step which is the results. The results are whether your findings based on the hypothesis are supported or refuted. In the activity I applied the steps of the scientific method by observing what was said in the captions and what was happening in the picture. I then had to question what was going on with my observation. I then made a hypothesis and tested the hypothesis and made a prediction. Then based on the outcome of the testing I found the conclusion and gathered the results.A real – life situation that I have used the scientific method would be when I flipped the light switch the light did not come on. I observed the light did not come on when I turned it on. I then questioned what may be the problem. Is it a burnt out bulb or something more complex. I then made a hypothesis on what I thought the problem was. My best guess was the light bulb was burnt out. I predicted that if I change the light bulb and put in a new one it would work just fine. I changed the light bulb and it was indeed burnt out. My hypothesis was supported. The Scientific Method The scientific method is a hypothesis-driven process of inquiry. The goal is to ask and answer scientific questions by making observations and doing experiments. This week we were asked to complete the scientific method activity on the student website. I participated in both experiments, but I found the car experiment to be a bit more of a challenge. I had to apply the steps of the scientific method several times before I finally arrived at a resolution. The Car Experiment. The car experiment began with an observation; something is wrong with the vehicle because it will not start. In an effort to explain my observation I ask the question; â€Å"Why won’t the vehicle start? † There could be a number of reasons why the vehicle will not start, so the next step is to hypothesize the solution and outcome. The website provided us with the following 3 hypotheses: 1. The car needs fluids. 2. The car battery is not working. 3. There are electrical problems. The next step is to make a prediction. I predicted that the vehicle must have an issue with the battery. I chose this hypothesis first, because it is not uncommon for someone to leave a dome light on and accidently drain their battery. While it is not uncommon to run out of fuel, I did not select this answer because in this day and age most vehicle owners keep an eye on their fuel levels to ensure that they have an adequate amount for the next day. The conclusion details the findings of your prediction. In this case the vehicle’s battery was fine. The results tie back into my hypothesis. The result was refuted, and I must now begin the process from the top to find the correct scientific method to remedy the problem. I had to repeat the scientific method 3 times until I found the solution to my problem. The vehicle had faulty electrical issues, and once the fuses were replaced it started right up. A real-life problem that I could use the scientific method to solve is a problem I have been having recently with my new vacuum. It is less than 3 months old and it has been acting strangely. I can use it one day for an hour without any problems, and two days later I can turn it on but it will only work for 3 or 4 minutes before shutting off. The steps that I would take to solve the problem are: 1. Make an Observation 2. Question: â€Å"Why is my vacuum not working properly? † 3. Thesis: Develop a hypothesis about why the vacuum may be acting strangely. It has electrical problems. It is clogged. It is faulty and I should contact the manufacturer. 4. Prediction 5. It was designed to help scientist and every day people who face problems come up with a logical and tested solution. According to authors Pruitt and Underwood (2006), The Scientific Method is defined as â€Å"the set of procedures that form the rational approach to studying the natural world. † This method can be applied to something dealing with science or something that deals with everyday life. In the below paragraphs, this writer will explain the scientific method and how it was used to achieve results in a web-based experiment as well as a real life situation. This writer would begin the web-based experiment by researching and discover why plants grow towards the light. Once the results of the search are gathered, this writer would produce a hypothesis. The possible hypothesis is; plants grow toward the light because it is a critical part of the process known as Photosynthesis. This writer’s prediction is that if a plant is placed to grow near a window, the plant will lean toward the light. For the experiment, this writer would put three plants on a table with a window to the left of them and three plants on a table with a window to the right of them. Over the course of three weeks, this writer will observe and document the plants reaction to the light coming through the window. After careful review of the information documented, this writer can safely conclude that the plants with the window to the right of them, grew bent toward the light and the plants with the window to the left of them grew bent toward the light. This information does support my hypothesis that plants grow toward the light to help with the Photosynthesis process. There were many problems that this writer could have tested, but decided to test the most important one of all. This writer’s daughter is at the stage in her life where she is taking off her pamper, but refuses to become potty trained. What is causing this? Not unlike other parents and scientists, this question came from a problem that needed a solution. Through personal experimentation as well as information compiled through secondary sources, this writer came up with effective ways to potty train their daughter properly. While observing the child, this writer noted that whenever the child needed to use the bathroom, she would cross her legs. After the child would receive some type of drink, approximately 20 minutes, she would again start to cross her legs. It became very apparent that the child was very ready to become potty trained. Through these observations, this writer produced her hypothesis. If this writer puts the child on the pot 20 minutes after she ingests any type of drink, the child will gradually become potty trained. This writer tried this method of potty training for two days. During those days, the child did successfully use the pot at the times this writer put her on it, but the child still had accidents on herself. With this information, this writer concluded that their methods were unsuccessful. This writer researched potty training techniques to construct a new hypothesis. According to the Mayo Clinic website (1998-2011), â€Å"when you notice signs that your child may need to use the toilet- such as squirming, squatting or holding the genital area- respond quickly. Once the child successfully uses the toilet, there should be some type of praise. Some people use stickers on a chart and others give special treats such as candy or an extra bedtime story (Infant and toddler health, 1998-2011). With using these techniques as well as cutting off all liquids that the child receives at eight o’ clock every day, this writer has found that the child has not had a day time potty accident in t hree days. Consistent monitoring of children while actively trying to potty train is the most important thing to do if successful results are desired. While potty training is no small feat, each parent who tackles this task knows that not every parent is the same and not all methods work for every child. This is something that will be learned on a case-by-case base. While the two experiments conducted are drastically different, they are both similar in the way that they both followed the Scientific Method. Benjamin Franklin: An American Life Essay

It is a fact that Benjamin Franklin was one of the only founding fathers to actively participate in all aspects of designing The United States of America. He was intricately involved in the Albany Plan of Union, the Declaration of Independence, the treaty of alliance with France, the peace treaty with England and the Constitution. His inventions included the flexible urinary catheter, bifocals, the lightning rod, Daylight Savings Time, and the United States Post Office. Franklin was a genius who was constantly thinking of a plan. This biography highlights his accomplishments, but also details the man behind the inventions and negotiations. It allows Benjamin Franklin to come off as a real person. It is written in a humble manner that allows the reader to respect Franklin for all aspects of his life, glamorous or not. Chapters One Through Three The first chapter of this biography discusses Benjamin Franklin’s arrival in Philadelphia at 17 years old. It also looks ahead briefly to an older Franklin and outlines his transformation through life. The chapter paints a friendly picture of Benjamin Franklin, outlining him as the â€Å"founding father who winks at us†. Isaacson clearly tries to get the reader to relate on a personal level to his subject. He wants to paint an open person with human faults, unlike some biographers who tend to place their subjects on pedestals. The author quickly lists some of Franklin’s accomplishments, but goes on to state that his biggest invention was the reinvention of himself. He states Franklin wanted nothing more than to create an America based on the values of the middle class citizens. The author successfully presents Benjamin Franklin in a humble and appealing manner, however it almost masks his great accomplishments at the same time. The author also highlights Franklin’s family history. He discusses Franklin’s great-grandfather Thomas Franklin and notes how he too was a rebel of some sort. Thomas Franklin kept an English Bible ties under a stool in his home when Queen Mary I outlawed them. The author does a fine job of outlining Benjamin Franklin’s heritage and his genetic ties to people who stand up for what they believe. The author goes on to state that all four generations of Franklins were similar to Thomas in that they were all likeable but they were also intelligent and non-conformists. They were all hard workers, and unlike many subjects of biographies, Benjamin Franklin was not born wealthy. The last part of this group discusses how after Franklin ran away, he moved to London to continue his training as a printer in 1724. Chapters Four Through Seven In 1726, Franklin returned to Philadelphia. He had saved enough money during his stay in London to begin his own business. He married Deborah Read in 1730, not completely out of love. The author goes into detail on how Franklin thought it was necessary to marry Read in order to give William a mother. Read was more than willing to take the job, and so they married. Isaacson goes into explanations on how Franklin’s business pursuits and personal life connect. He recalls facts such as Franklin’s successful acquisition of the Pennsylvania Gazette and his publishing of the annual Poor Richard: An Almanack. Personally, Franklin goes through years of births and deaths of those close to him. The births of William, Francis, and Sarah and the deaths of Francis, his mother Abiah and his father Josiah are also discussed. Some of the most interesting parts of the book are those where Franklin’s inventions and their history are discussed. It is interesting to realize that some of Franklin’s best ideas were not fabricated easily. Isaacson is true to history as he tells of Franklin’s successes and failures. This applies with Franklin’s inventions but also in his personal and political life. Isaacson also does Franklin justice by mentioning his great contributions as a citizen to the state of Pennsylvania. His participation in the organization of the fire department, police department, the public library, the post office, and what later became the University of Pennsylvania are noted as well. Franklin basically set up the complete plan of what a functional town should look like. Chapters Eight Through Eleven Benjamin Franklin spent several years traveling in London. He was a representative of the Pennsylvania Assembly. He was originally sent there to petition the king for tax levies. Isaacson does a nice job detailing the successes and failures of Franklin during this time. He shows the respect Franklin had as a negotiator and why he was sent on such important business. The book is true to life when Isaacson speaks of failures in Franklin’s career and personal life such as the ruin of his reputation for the Hutchinson Letters leak. Isaacson also is articulate in explaining the negotiations involving Franklin that ultimately ended the American War of Independence. The personal inclusion of the death of Franklin’s wife, whom he live apart from for the last eighteen years of their marriage, brings the story back to a more intimate level as well. Chapters Twelve Through Fifteen Isaacson makes sure the reader is aware of the impact Franklin had on the writing of the Declaration of Independence. The organization of America was one of Franklin’s most important achievements. The author does well in recording this meaningful accomplishment. Franklin traveled to France during this time in his life. The people of France came to love Franklin and respected him greatly. Isaacson showed no mercy in mentioning Franklin’s love of flirting with French women. He was a fantastic negotiator and Isaacson really attempts to capture the spell he had under the people of France as well as Louis XVI. He helped the French government draw up a treaty of commerce and defensive alliance. He was considered a hero there but he did not always feel like the hero he was thought to be. The author does a great job of pointing out Franklin’s confident times as well as times he was a bit insecure. Chapters Sixteen Through Eighteen Three years before his death, Franklin was elected president of the Pennsylvania Society for Promoting the Abolition of Slavery. Slavery was an issue that had come close to his heart and even in his final months of life, he signed a petition to call for the end of slavery. He spent the last year of his life bedridden and died in Philadelphia on April 17, at the age of 84. Isaacson does a great job capturing the reader at the end of the story. Reading about Franklin’s death is an emotional experience. Isaacson goes on to write more about Franklin’s legacy after his death. Overview It is clear that Isaacson set out to write a positive, but true biography. Although he does an adequate job of detailing even the most unpleasant aspect of Franklin’s life, you can tell within the first few chapters that he is on Franklin’s side. He develops a story of Franklin that appeals to the reader. Even after hearing what a less than average husband he was and his knack for self-promotion, the reader will most likely be forgiving due to the clever writing. By the end of the long book, the reader is a fan of Franklin’s as well. The book does tend to drag in certain areas however. The content is full of history and accomplishments but it does not completely draw in the reader fully. There are many chapters in which a non-committed reader may put the book for good. Overall however, it is a true depiction of the Benjamin Franklin, the greatest inventor, negotiator, and citizen America may ever see. Bibliography Isaacson, Walter. 2003. End of Life Essay

According to IOM (2008), the next generation of older adults will be like no other before it. It will be the most educated and diverse group of older adults in the nation’s history. They will set themselves apart from their predecessors by having fewer children, higher divorce rates, and a lower likelihood of living in poverty. But the key distinguishing feature of the next generation of older Americans will be their vast numbers. According to the most recent census numbers, there are now 78 million Americans who were born between 1946 and 1964. By 2030 the youngest members of the baby boom generation will be at least 65, and the number of older adults 65 years and older in the United States is expected to be more than 70 million, or almost double the nearly 37 million older adults alive in 2005. The number of the â€Å"oldest old,† those who are 80 and over, is also expected to nearly double, from 11 million to 20 million (Institute of Medicine of the National Academies [IOM], 2008, p. 29). The United States health care system faces enormous challenges as the baby boomer generation nears retirement age. Current reimbursement policies, workforce practices, and resource allocations all need to be re-evaluated, and redesigned in order to prepare the health care system for meeting the needs of the inevitably growing population of older adults. Areas such as education, training, recruitment, and retention of the health care workforce serving older adults will require remodeling. To accomplish this will require the dedication and allocation of greater financial resources, even at a time when budgets are already be severely stretched. â€Å"The nation is responsible for ensuring that older adults will be cared for by a health care workforce prepared to provide high-quality care. If current Medicare and Medicaid policies and workforce trends continue, the nation will fail to meet this responsibility. Throwing more money into a system that is not designed to deliver high-quality, cost-effective care or to facilitate the development of an appropriate workforce would be a largely wasted effort† (IOM, 2008, p. 1-12). Ethical Standards for Resource Allocation Ethics have a paramount role in solving the complex dilemmas surrounding the aging population and health care. There are several ethical standards I believe should be used in determining resource allocation for the aging population and end of life care. Yet realistically, most are unreasonable with the already limited resources available for health care. Unfortunately difficult decisions need to be made in the allocation of resources. Three primary ethical standards that could realistically improve health care for the aging, which I believe should determine resource allocations are: 1. Autonomy: suggest that individuals have a right to determine what is in their own best interest, though that interest may be limited if exercising that right limits the rights of others. 2. Beneficence: means that clinicians should act completely in the interest of their patients. Compassion; taking positive action to help others; desire to do good; core principle of our patient advocacy. 3. Justice: implies fairness and that all groups have an equal right to clinical services regardless of race, gender, age, income, or any other characteristic (Teutsch & Rechel, 2012, p. 1). It is inevitable that difficult decisions have to be made regarding how health care resources will be allocated for the aging and dying. In my opinion scarce health care resources should be offered as fair as possible (justice), to do the most good for the patient in every situation (beneficence), with respect of the individual human right to have control of what happens to their own body (autonomy). Elderly and end of life patients have a right to care that is dignified and honest. The three ethical standards noted above should be the driving force behind determining health care resource allocations, allowing for quality care delivery, tailored to individual health needs at any stage of â€Å"aging† through the end of life, ensuring protection and satisfaction to such a vulnerable patient population. As stated by Maddox (1998), perhaps the impact of the array of problems, issues, and the myriad difficult decisions that policymakers and managers make may be softened by imaginative and rational strategies to finance, organize, and deliver health care when resources are scarce. Decisions related to scarce resource allocations must be made in consideration of the ethical principles of autonomy, beneficence, and especially justice. Ethical issues related to scarce resource allocation are likely to become increasingly complex in the future. Thus, it is imperative that health care leaders diligently and ethically continue to explore these issues (Maddox, 1998, p. 41). Somehow, while using the three standards noted, we need to reform our health care system to benefit the aging and dying, and adhere to the codes of conduct the best way possible with the limited resources available. If there is a will, there is a way! Ethical Challenges The critically challenging ethical issue of â€Å"aged based health care rationing† is faced when preparing for an adequate health care system that will meet the care needs of the aging and dying. According to AAM (1988), the rationale for a program of health care rationing based on age rests on the assumption that society should allocate its resources efficiently, and that age-based rationing represents the most efficient method of resource allocation. Within this context, it has been argued that since most of the elderly are not in the work force they do not directly benefit society. Although the elderly, it is argued, should be provided with basic necessities and comfort, the greatest portion of health care resources, including expensive medical technologies, are better deployed on younger, more productive segments of the population (American Medical Association [AMA], 1988, p. 1). One tool developed by economist that has been used to measure value of ones life so to speak is known as â€Å"quality adjusted life years or QALY†. It is a widely used measure of health improvement that is used to guide health-care resource allocation decisions. The QALY was originally developed as a measure of health effectiveness for cost-effectiveness analysis, a method intended to aid decision-makers charged with allocating scarce resources across competing health-care program (Kovner & Knickman, 2011, p. 258). Another common term for health care rationing is known as the â€Å"death panel, or Obama Death Council†. This panel is a government agency that would decide who would receive health care and who would not receive health care based on some form of standard implemented by the government. One difficult ethical question posed is, if we do ration health care, who decides how it is rationed, when and why? The advocates of rationing argue that society benefits from the increase in economic productivity that results when medical resources are diverted from an elderly, retired population to those younger members of society who are more likely to be working. As stated by Binstock (200), promoting age-based rationing is detrimental to the elderly because it devalues the status of older people and caters to the values of a youth- oriented culture, a culture in which negative stereotyping based on age is prevalent. One possible consequence of denying health care to elderly persons is what it might do to the quality of life for all of us as we approach the â€Å"too old for health care† category. Societal acceptance of the notion that elderly people are unworthy of having their lives saved could markedly shape our general outlook toward the meaning and value of our lives in old age. At the least it might engender the unnecessarily gloomy prospect that old age should be anticipated and experienced as a stage in which the quality of life is low. The specter of morbidity and decline could be pervasive and over- whelming (Binstock, 2007, p. 8). Other ethical challenges related to the provisions of aging based health care are: 1. Lack of education amongst health care providers in meeting the care needs of the aging and dying as well as providers faced with ethically challenging decisions especially at the end of life. 2. Lack of funds to support the diverse and challenging health needs of the aging, and promotion of comfort when dying, whether it be funds for care, facility placement, or ability to hire enough staff to me the high demands of a large population, and education. 3. Cost effectiveness vs. quality of care vs. quality of life â€Å"In the end, there is no â€Å"solution† to the problem of aging, at least no solution that a civilized society could ever tolerate. Rather, our task is to do the best we can with the world as it is, improving what we can but especially avoiding as much as possible the greatest evils and miseries of living with old age: namely, the temptation of betrayal, the illusion of perpetual youth, the despair of frailty, and the loneliness of aging and dying alone† (Georgetown University, 2005, para. 62). One way or another it is imperative to our aging society that a health care system is developed under the principals of autonomy, beneficence, and justice that will not deliver care based on rationing and determination of ones’ worth, but based on the individual and their health needs that will facilitate optimal aging and peaceful dying. Equal Opportunities

In this essay I am going to explain the term † equal opportunities† in relation to early years practice. Explore this in the context of the UN Convention on the Rights of the Child and explain the impact the Convention on UK legislation. I am also going to suggest some steps which in my consideration can implement equality of opportunity for children in UK. Equal opportunity is a descriptive term for an approach intended to give equal access to a certain social environment or to ensure people are not specifically excluded from participating in activities such as education, employment or health care on the basis of immutable traits. The lack of access might cause poor self-esteem, respect, misunderstandings, stereotyping and discrimination. Bruce and Meggit, 2002) Also it means opening up the universe for the child and family so that they can take full benefit of the early childhood activities in school and in society. Equal opportunity does not mean treating everyone the same. The Common areas of discrimination are race, financial capability, gender and the ability of the child. Every child's future depends on opportunities provided to it in his early years of life which usually defines the child's outlook towards life. This will be the window through which the child will define race, gender, nationality, religion, family set-up, special needs and sexual orientation of parents in his or her own way. The teacher and parents will play the most vital role in the child's early years of development and they will be providing all the vital elements of this process to build the child's future. Teachers and parents have to make sure that he is in the right environment for this development to take place. To help them, the UN has played a major role and contributed immensely to this process. The UN general assembly agreed to adopt the conventions on the rights of the child on November 20th, 1989. It came into force in September 1990 after it was ratified by 192 member nations. The convention is child centric and deals with child specific needs and right to education and care. It also looks after the best interest of the child. Articles 2,3,6,7,8,11,12,13,23,28,29,30,31,32,34,35 are related specifically to the early years in respect to education and care. These articles of the policy state that the member nations will respect the rights set forth in the present convention to each child within their jurisdiction without discrimination of any kind. (Convention on the rights of the child, 1990) The Convention on the Rights of the Child applies in the UK since ratification in December 1991, when the government agreed to make all laws, policy and practice compatible with the UN Convention. (http://www. unicef. org) Every child has certain basic rights, including the right to life, his/her own name and identity, and to be raised by his/her parents within a family or cultural grouping and have a relationship with both parents, even if they are separated. † (www. wikipedia. org) The principals outlined in the international human rights framework apply to both children and adults. I am doing to concentrate on children which are mentioned especially in many of the human rights. Standards are specially modified or adapted where the need an d concerns surrounding are distinct for children. http://www. child-abuse. com) The Convention on the Rights of the Child recognizes and promotes this great link between children’s rights and responsibilities. The aims of education defined in the Article 29, include nurturing children’s respect for human rights, for their own and others cultural values and for the environment. This Article teaches us how vital it is for every child from birth to be thought tolerance and approval for people of other cultural and be able to get access to the same level and standard of education. Children need to be involved in process of learning about other cultures in order to understand them better. In this way children become familiarly with all the information, accept them and learn that everybody has equal rights and deserve approval and respect from Other people, no matter how old they are. (UN Convention, Article 29) Other articles express children’s rights in terms that stress how children’s exercise of those rights must be responsible and respectful of the rights of others. Article 15, states that children have the rights to meet with others and to join or set up association, unless the fact of their doing so would violate the rights of others. . Every child should be allowed to join those groups, in this way children learn about each other and build up their level of tolerance. Through social life children and young people meet and observe other children and learn from each other. (UN Convention, Article 15) Another example of children rights is Article 31 which again promotes the rights to rest and leisure, play and recreational activities appropriate for the age of the child. Children need to have the time to re-charge they energy, rest and play with each other or, and on their own. In many situations we learn about children who have to work long hours and very often do not get enough sleep at night. This is when we could mention children being explored, hard working children who have no time for cultural, artistic or leisure activities. (UN Convention, Article 31) In upholding the rights of children, the Convention does not infringe on the rights of parents to decide what is best for their children. Instead, it specifically states that governments shall make every effort to keep families intact and shall provide support and assistance to parents in fulfilling their responsibilities with regard to the upbringing and development of their children. The promotion of children's rights is not a matter of placing children in conflict with the adult authorities in their lives, but of encouraging all citizens to work together for a safe, healthy and productive future for children. (http://www. unicef. org) Parents, carers, families and teachers are the most important influence on outcomes for children and young people. The Every Child Matters: Change for Children programme aims to ensure that support for parents becomes routine, particularly at key points in a child or young person’s life. (http://www. crin. ch) The UK government aim is for every child, whatever their background or their circumstances, to have the support they need to be healthy, stay safe, enjoy and achieve, make a positive contribution, achieve economic well-being. This means that the organizations involved with providing services to children-from hospitals and schools, to police and voluntary groups- will be teaming up in new ways, sharing information and working together, to protect children and young people from harm and help them achieve what they want in life. Children and young people will have far more say about issues that affect them as individuals and collectively. (http://www. cre. gov. uk) The Children’s Commissioner for England was appointed, to give children and young people a voice in government and in public life. The Commissioner will pay particular attention to gathering and putting forward the views of the most vulnerable children and young people in society, and will promote their involvement in the work of organizations whose decisions and actions affect them. The Commissioner’s role is to observe every aspect about young children and react immediately if something is acting against they rules and believes. (http://www. cre. org. uk) By agreeing to undertake the obligation of the convention, UK’s government have committed themselves to project and ensure children’s rights as they agreed to hold themselves accountable for the commitment before the international community. State parties to the convention are obliged to develop and undertake all actions and polices in the best interest of the child. The task, however, must engage not just governments but all members of society. The standards and principles articulated in the convention can only become a reality when they are respected by everyone within the families, in school and other institution that provide service for children, in communities and at all levels of administrations. (MCI protocol) The DfES (Department for Education and Slikks) works in partnership with community foundations, rural community councils, councils for voluntary service and grant making trusts to provide an experienced fund administrator in each area. Administrators ensure that outreach and support are available to support applicants. Decisions on allocating funding are made by assessment panels comprised of people with knowledge of the issues faced by children in the communities served by the funds. (http://dfes. gov. uk) New child charities have been recognised all over country helping to promote and claim children’s rights, and monitor how far their are being realised and respected. The charities collaborate with government and civil society to make progress in realising children’s rights. The UN committee welcomed a number of UK initiatives, especially new legislation such as the Human Rights Act and Adoption and Children Bill, youth participation, the available strategy for children, young people, and strategies on child poverty and teenage pregnancy. ( http://www. publication. parliament. uk). All parts of government have a responsibility to learn about, promote and implement the convention. The children, young people and families directorate within the department for education and skills co-ordinates the government’s report to the committee on the rights of the child. Beverley Hughes MP, the minister for children, young people and families, has special responsibility within the government for ensuring the convention is put into practice. The government is also meant to make sure that all new laws fit with the convention. Children’s rights groups and organisations have an important role to play in raising awareness about the convention, and referring to it whenever decisions are made that affects children and young people. All schools actively seek to engage parents in children and young people's education, helping parents to understand what they can do at home to work with the schoolchildren’s centres and extended schools develop a coherent set of services both to support parents and to involve them properly at all stages of a child's learning and development. (http://www. crin. ch) In conclusion, we should all apply the equal opportunities policy and each on of us should begin by him/herself. We should treat anyone an adult or a child equally regardless of his gender, race, nationality, social class and religion because he/she is an important part of the society we live in, and has a major role in it, especially children because they are the future generation, who will take our place in the society.
